1. About these terms
Smash English is operated by Debra-Jayne Kimlin T/AS SmashEnglish.com, PO Box 299, Carlton North, Victoria 3054, Australia ("we", "us"). By creating an account or using the site you agree to these terms. If you don't agree, please don't use the site.
2. Who may use Smash English
The site is designed for school students and English learners. If you are under 18, you may use Smash English with the involvement of a parent, guardian or teacher, who accepts these terms on your behalf. Anyone entering payment details must be at least 18.
3. Your account
- Give accurate details when you sign up and keep them current.
- Keep your password private. You're responsible for what happens under your account.
- One account per person. Accounts are personal and must not be shared, sold or used by a class as a group login.
- The learning level you choose at signup is locked to your account, because progress, badges and access are tied to it. Contact us if it was set incorrectly.
- Tell us straight away if you think someone else is using your account.
4. Free accounts
- Visitors who are not signed in may browse the whole quiz library, but an account is required to play any quiz.
- FREE accounts may complete one quiz per day within their chosen level for 7 days from sign-up.
- These limits are part of the service and may change. Attempting to bypass them — through multiple accounts, scripts or clearing storage — is a breach of these terms.
5. Subscriptions and payment
- Paid access is sold by level (year group, or ESL as a single level) and unlocks all quizzes in that level.
- Prices are in Australian dollars and shown on the pricing page before you pay.
- Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period until cancelled.
- You can cancel at any time from Manage Subscription. Cancelling stops future charges; access continues until the end of the period you've paid for.
- We may change prices with notice. Changes apply from your next billing period.
6. Refunds
Because access is granted immediately, payments are generally non-refundable once a billing period has started. If something goes wrong — you were charged twice, the site was unavailable, or you cancelled and were billed anyway — contact us and we'll sort it out. Nothing here limits your rights under the Australian Consumer Law.
7. Coupon codes
- Coupon codes are unique and single-use. Once redeemed a code cannot be used again.
- A redeemed coupon gives one month of access at the member's own year group or level.
- At the end of that month, the account returns to FREE unless a paid subscription is started.
- Codes have no cash value and may be cancelled if obtained or shared improperly.
8. Fair use
When using Smash English you must not:
- copy, scrape, download in bulk, republish or resell quizzes, questions, images or explanations;
- use bots, scripts or automated tools to answer quizzes, farm points and coins, or manipulate leaderboards, streaks or battles;
- share answers or attempt to extract answers from the system;
- probe, overload or interfere with the site, its rate limits or its security;
- upload or send abusive, harassing or unlawful content through help chats, reports, battles or profile fields.
If you breach this section we may reset points, remove badges, suspend or delete your account, and where appropriate withhold a refund.
9. Our content
All quizzes, questions, explanations, illustrations, characters, branding and site design remain our property or that of our licensors. You get a personal, non-transferable licence to use them for your own learning while your account is active. Teachers may use the site with students but may not reproduce our content in their own materials without written permission.
10. Availability and changes
We work to keep the site available, but we can't promise it will be uninterrupted or error-free. We may add, change or remove quizzes, features and levels over time. If we make a significant change that affects paid access, we'll tell you.
11. Liability
Smash English is an educational practice tool. We don't guarantee any particular academic result. To the extent permitted by law, our liability for any claim connected with the site is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.
12. Suspension and ending your account
You can close your account at any time. We may suspend or close an account that breaches these terms, or where required by law. On closure your access ends and your information is handled as described in our Privacy Policy.
13. Changes to these terms
We may update these terms. The date at the top shows the latest version, and continued use of the site after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction over any dispute.
